Report: ICE figures "cooked" by Biden admin
Illegal aliens arrested for trafficking 15-year-old in NC
Acting ICE Director says Biden “cooked the books” on ICE figures
"We have uncovered that the previous administration… was cooking the books on ICE data," acting ICE Director Todd Lyons told reporters on Mar. 12, per FOX News. "They were purposely misleading the American people by categorizing individuals processed and released into the interior of the United States as ICE arrests."
"A comprehensive review was done internally here with ICE,” said Lyons. “We found tens of thousands of cases that were recorded as arrests when, in fact, these instances were illegal aliens that were simply processed and released into the American communities.”
More from the FOX News report:
Senior officials said that the majority of the overall 113,431 arrests made in FY 2024 were "pass-through" arrests, meaning that ICE didn’t take an enforcement action against those foreign nationals, and they instead just passed through ICE before being released into the interior and were told to report to an ICE office.
They stressed that none of the arrests made by ICE under the Trump administration have been pass-through arrests.
"What we are doing now is actual immigration enforcement, not enforcement theater," an official said.
As for interior arrests, in FY 2024, ICE enforcement removal operations made 33,242 at-large arrests, only 29% of all ICE arrests. For comparison, officials say that ICE made 32,809 arrests from Jan. 20 to March 10, meaning they will surpass the FY 2024 number this week.
Of those arrests, 14,111 were convicted criminals and 9,980 have pending criminal charges. Over 1,150 were suspected gang members, two and a half times the 483 arrested in the same period last year.
“Pass through arrests” seem more like gotaways based on what ICE described them as.

President Trump issued an Executive Order utilizing the Alien Enemies Act of 1798 with regard to the removal of members of the violent Venezuelan gang Tren de Aragua.
This act has been used three times in U.S. history, during the War of 1812, World War I and World War II. Once invoked, the Act gives the president broad powers to remove individuals from the country.
Here is the text of the Act, with emphasis added:
§21. Restraint, regulation, and removal
Whenever there is a declared war between the United States and any foreign nation or government, or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government, and the President makes public proclamation of the event, all natives, citizens, denizens, or subjects of the hostile nation or government, being of the age of fourteen years and upward, who shall be within the United States and not actually naturalized, shall be liable to be apprehended, restrained, secured, and removed as alien enemies. The President is authorized in any such event, by his proclamation thereof, or other public act, to direct the conduct to be observed on the part of the United States, toward the aliens who become so liable; the manner and degree of the restraint to which they shall be subject and in what cases, and upon what security their residence shall be permitted, and to provide for the removal of those who, not being permitted to reside within the United States, refuse or neglect to depart therefrom; and to establish any other regulations which are found necessary in the premises and for the public safety.
Read the order: Invocation of the Alien Enemies Act Regarding the Invasion of The United States by Tren De Aragua
Trump has designated Tren de Aragua and multiple drug cartels as terrorist organizations, yet within hours of the order being issued, James E. Boasberg, chief judge of the District Court for the U.S. District of Columbia, issued a temporary 14-day restraining order in response to a lawsuit filed by the ACLU and Democracy Forward.
Boasberg was appointed to the federal bench by former President Barack Obama in 2011.
Democracy Forward (DF) is a 501(c)3 that can arguably be described as lawfare outfit which also has a dark money 501(c)4 arm.
Capital Research Center’s Influence Watch describes DF as “a left-of-center litigation and advocacy nonprofit created in early 2017 by high-level Democratic Party operatives,” and the group “has been aggressive in targeting the Trump administration.”
Influence watch also notes that Hillary Clinton campaign attorney Marc Elias chairs the DF board.
