There’s a new set of information out on Kilmar Garcia he deported MS-13 member, now known as the famous “Maryland Man.”
The question of whether Garcia was "wrongly deported" to El Salvador appears to be solved per a 2019 DOJ Immigration filing order that concludes he is a "native and citizen" of El Salvador.
The filing also cites Garcia’s concerns about going back to El Salvador due to persecution by the gang "Barrio 18," but as one continues to read the document, that continued activity stems from harassment actions in Guatemala, not El Salvador.
"At present, even though the family has now shut down the pupusa business, Barrio 18 continues to harass and threaten the Respondent's two sisters and parents in Guatemala."
The filing also says Garcia "...has not shown that it is "more likely than not" that he would be tortured if he were to be removed to El Salvador."
The filing's conclusion sums up that there is no reason not to send him back to El Salvador.
"The Respondent's application for asylum is time-barred without exception. However, he has established past persecution based on a protected ground, and the presumption of a well-founded fear of future persecution. DHS has not shown there are changed circumstances in Guatemala that would result in the Respondent's life not being threatened, or that internal relocation is possible and reasonable under the circumstances. Therefore, the Respondent's application for withholding under the Act is granted. Finally, his CAT claim fails because he has not shown that he would suffer torture."
In addition to this 2019 filing, we have a new report tying Garcia to human trafficking.
Just the News found evidence Garcia was pulled over driving the vehicle of a known human trafficker
"When Abrego Garcia was stopped in 2022 by the Tennessee state trooper, Homeland Security intelligence created a record of the encounter, Just the News reported. The El Salvadoran was driving a black 2001 Chevrolet Suburban and said he was transporting his passengers to Maryland from Texas for construction work, although the state trooper found no luggage in the SUV."
Garcia told the trooper the car belonged to his boss, Jose Ramon Hernandez Reyes. Both the car and Reyes were flagged as being involved in human trafficking.
Just the News also reported that Garcia was flagged for suspected human trafficking in 2022 by the Biden administration.
Garcia's case as a "wrongly deported" man is quickly falling apart, so there is now a new "Maryland man" case, but we're not allowed to know his full name for vetting purposes. Read about this case at the Wall Street Journal.
More To The Story
A People's Town Hall
In North Carolina, Democratic Congressman Max Frost (FL) and Sen. Chris Murphy (CT) headlined the NC Democratic Party's "People's Town Hall" in Saxapahaw yesterday.
Both men have been on television and social media defending Garcia.
Frost even went to El Salvador.
NC House Speaker Destin Hall, who has been trying to shore up law enforcement's cooperation with ICE in NC, welcomed them to the state.
Hall dropped a second zinger.
During the event NC Democratic Party Chair Anderson Clayton thanked the owner of the "Hall River Ballroom,"where the event was being held.
"It can be a really trying time for a business to step up and host something like this," Clayton said.
Also giving remarks at the town hall was NC Supreme Court Justice Anita Earls. At the heart of her remarks were attacks on the state's congressional maps. She said that "if we had fair maps," NC Democrats would not have lost three seats, which in turn lost the party control of the U.S. House.
"The most important thing I want you to know, is that if you want to change what is happening in Washington or in Raleigh, the only path to fair representation for all of North Carolina's voters is through the state courts," Earls told attendees.
"If you think that policymakers in Washington and in Raleigh are not being responsive to your needs because of the impact of extreme partisan gerrymandering in our elections the only way to fix that is to have a state court that will enforce your rights"
Earls then went on to make arguably partisan remarks about the NC Supreme Court race case between Assoc. Justice Allison Riggs and Court of Appeals Judge Jefferson Griffin, that the NC Supreme Court had recent direct involvement in.
"And I want to tell you just a word about what I said about the Griffin case because I did issue a dissent to our court's order,” said Earls. “And I said it is no small thing to turn over to overturn the results of an election in a democracy by throwing out ballots that were legally cast consistent with all election laws in effect on the day of the election some would call it stealing the election others might call it a bloodless coup but by whatever name, no amount of smoke and mirrors makes it legitimate."
Earls and Riggs were business partners prior to their time on the bench. The pair sued the state on topics like redistricting through their organization, the Southern Coalition for Social Justice.
Earls also echoed political topics that her colleague Riggs spoke of in campaign ads -- of which earned her an ethics complaint being filed against her which alleged she was violating the judicial code of conduct in her campaign ads. The complaint is still active as far as I know.
"So I hope you will agree with me that state courts matter a lot,” Earls continued. “You deserve a court that will protect your right to vote a court that will protect your right to a clean environment, your right to control your own body, your right to a government that is responsive to your needs and concerns, and your children's right to a sound basic education."
"I am running for reelection to keep my seat on the North Carolina Supreme Court,” Earls said in her closing remarks. “I'll be on your ballot in and I ask for your support, thank you. You can sign up at my website earls forjustice.com."
The Blue Ridge Times Substack also noticed Earls’ remarks possibly crossing the Judicial Code of Conduct. Check out their article here.
Murphy posted video of the entire “People’s Town Hall “event on his YouTube channel, which can be viewed below. If one visits Murphy’s channel, he’s posted videos of his appearances at “People’s Town Halls” in multiple states.
